1. Agreement to Terms

Welcome to PizzaPizza! These Terms of Service ("Terms") govern your access to and use of our pizza delivery services, website, mobile applications, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use our Services. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Services following any changes indicates your acceptance of the new Terms.

Important Notice

By placing an order through PizzaPizza, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you are placing an order on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

1.1 Eligibility

You must be at least 18 years of age to use our Services and place orders. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are under 18, you may only use our Services with the involvement and consent of a parent or legal guardian.

1.2 Account Registration

To access certain features of our Services, you may be required to create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information during the registration process
  • Maintain and promptly update your account information to keep it accurate and complete
  • Maintain the security of your password and accept all risks of unauthorized access to your account
  • Immediately notify us of any unauthorized use of your account or any other breach of security
  • Take responsibility for all activities that occur under your account

2. Order Placement and Acceptance

When you place an order through our Services, you are making an offer to purchase pizza and related products from PizzaPizza. All orders are subject to acceptance by us, and we reserve the right to refuse or cancel any order for any reason, including but not limited to:

  • Product availability or limitations on quantities available for purchase
  • Inaccuracies or errors in product or pricing information
  • Suspected fraudulent, unauthorized, or illegal activity
  • Delivery address outside our service area
  • Previous payment issues or order history concerns
  • Force majeure events or circumstances beyond our reasonable control

2.1 Order Confirmation

Once you submit an order, you will receive an order confirmation via email or SMS to the contact information provided. This confirmation does not constitute our acceptance of your order. We will send you a separate notification when your order has been accepted and is being prepared. Until you receive this acceptance notification, we reserve the right to decline your order.

2.2 Pricing and Payment

All prices displayed on our Services are in Canadian Dollars (CAD) and include applicable taxes unless otherwise stated. We reserve the right to change prices at any time without prior notice. However, price changes will not affect orders that have already been accepted by us.

2.3 Payment Methods

We accept various payment methods including credit cards (Visa, Mastercard, American Express), debit cards, and digital payment platforms. Payment is processed at the time of order placement. By providing payment information, you represent and warrant that you are authorized to use the payment method and authorize us to charge the total amount of your order to that payment method.

2.4 Promotional Codes and Discounts

Promotional codes and discounts are subject to specific terms and conditions, which will be provided at the time of the promotion. Unless otherwise stated, promotional codes:

  • Cannot be combined with other offers or promotions
  • Are valid for a limited time and may expire without notice
  • Are non-transferable and have no cash value
  • May be subject to minimum order requirements
  • Are limited to one use per customer unless otherwise specified

3. Delivery Services

PizzaPizza offers delivery services within designated service areas in Canada. Delivery times are estimates only and may vary based on factors including order volume, weather conditions, traffic, and other circumstances beyond our control.

3.1 Delivery Areas and Times

Our delivery services are available in specific geographic areas around our locations. You can verify if your address is within our delivery area by entering it during the order process. Standard delivery times range from 30 to 60 minutes, though actual delivery times may vary. We will make reasonable efforts to deliver your order within the estimated time frame, but we do not guarantee specific delivery times.

3.2 Delivery Instructions

You may provide special delivery instructions when placing your order. While we will make reasonable efforts to accommodate these instructions, we cannot guarantee compliance in all circumstances. Instructions that compromise driver safety or violate our policies will not be followed.

3.3 Failed Deliveries

If we are unable to complete delivery due to incorrect address information, inaccessibility of the delivery location, or your unavailability to receive the order, you will still be charged for the order. We will attempt to contact you using the contact information provided, but if we cannot reach you or complete the delivery within a reasonable time, the order may be cancelled without refund.

3.4 Contactless Delivery

We offer contactless delivery options for customer safety and convenience. When selecting contactless delivery, the driver will leave your order at your specified location and notify you of the delivery. By choosing this option, you accept responsibility for the order once it has been delivered to the specified location.

Safety First

The safety of our customers and delivery drivers is our top priority. We reserve the right to refuse delivery to any location that our drivers deem unsafe. This includes but is not limited to locations with aggressive animals, hazardous conditions, or threatening behavior.


4. Product Quality and Food Safety

We are committed to providing high-quality food products prepared in accordance with Canadian food safety standards and regulations. All our products are prepared fresh using quality ingredients, and we maintain strict hygiene and safety protocols in our kitchens.

4.1 Allergen Information

We provide allergen information for our menu items to the best of our ability. However, our kitchen facilities handle various ingredients including common allergens such as wheat, dairy, eggs, soy, nuts, and shellfish. Cross-contamination may occur despite our best efforts to prevent it.

Important: If you have food allergies or dietary restrictions, it is your responsibility to review our allergen information and contact us directly before placing an order. We cannot guarantee that any menu item is completely free from allergens, and we are not liable for allergic reactions resulting from consuming our products.

4.2 Product Descriptions

We strive to provide accurate descriptions and images of our menu items. However, actual products may vary slightly from images and descriptions due to natural variations in ingredients, preparation methods, and presentation. Product availability is subject to change without notice.

4.3 Temperature and Freshness

Our products are prepared fresh and delivered hot. Once delivered, it is your responsibility to consume or properly store the food. We are not responsible for the quality or safety of products after delivery, particularly if they are not consumed or refrigerated promptly.

4.4 Quality Concerns

If you have concerns about the quality of your order, please contact us immediately at 519-284-2083 or orders@pizzaipizza.org. We take quality concerns seriously and will work to resolve issues promptly. To facilitate resolution, please:

  • Contact us within 2 hours of delivery
  • Provide your order number and details of the concern
  • Retain the product and packaging for inspection if requested
  • Provide photographic evidence if possible

5. Cancellations and Refunds

We understand that circumstances may require you to cancel or modify an order. Our cancellation and refund policies are designed to be fair to both customers and our business operations.

5.1 Order Cancellation

You may cancel your order before it has been accepted and preparation has begun. Once preparation has started, orders cannot be cancelled. To request a cancellation, contact us immediately at 519-284-2083. If your cancellation is successful, you will receive a full refund to your original payment method within 5-10 business days.

5.2 Refund Policy

Refunds may be issued in the following circumstances:

  • Order cancelled before preparation begins
  • Significant quality issues with the delivered product
  • Incorrect items delivered that cannot be corrected
  • Failure to deliver within a reasonable timeframe due to our error
  • Duplicate charges or billing errors

Refunds will not be issued for:

  • Change of mind after order acceptance
  • Minor variations in product appearance from images
  • Delivery delays due to circumstances beyond our control
  • Failed delivery due to incorrect address or customer unavailability
  • Dissatisfaction with taste or personal preferences

5.3 Refund Processing

Approved refunds will be processed to your original payment method within 5-10 business days. The time it takes for the refund to appear in your account may vary depending on your financial institution. Partial refunds may be issued for orders where only some items were affected by quality issues.

5.4 Store Credit

In some cases, we may offer store credit as an alternative to refunds. Store credit can be applied to future orders and does not expire. Store credit is non-transferable and has no cash value.


6. Intellectual Property Rights

All content included in or made available through our Services, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of PizzaPizza or its content suppliers and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

6.1 Trademarks

The PizzaPizza name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of PizzaPizza or its affiliates. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans mentioned in our Services are the trademarks of their respective owners.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial purposes in accordance with these Terms. This license does not include any right to:

  • Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content or information obtained from our Services
  • Use any data mining, robots, or similar data gathering or extraction methods
  • Download any content except as expressly permitted on our Services
  • Use our Services for any commercial purpose or for the benefit of any third party

6.3 User Content

If you submit reviews, comments, photos, or other content to our Services, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media. You represent and warrant that you own or have the necessary rights to submit such content and that the content does not violate any third-party rights.


7. User Conduct and Prohibited Activities

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to engage in any of the following prohibited activities:

7.1 Prohibited Uses

  • Violating any applicable local, provincial, national, or international law or regulation
  • Impersonating or attempting to impersonate PizzaPizza, our employees, another user, or any other person or entity
  • Engaging in any conduct that restricts or inhibits anyone's use or enjoyment of our Services
  • Using our Services in any manner that could disable, overburden, damage, or impair our systems
  • Using any robot, spider, or other automatic device to access our Services for any purpose
  • Introducing any viruses, trojan horses, worms, logic bombs, or other malicious or technologically harmful material
  • Attempting to gain unauthorized access to any portion of our Services or any systems or networks connected to our Services
  • Harassing, abusing, or harming our employees, delivery drivers, or other users
  • Using our Services to transmit any advertising or promotional material without our prior written consent
  • Placing fraudulent orders or using stolen payment information

7.2 Account Suspension and Termination

We reserve the right to suspend or terminate your account and refuse any current or future use of our Services if we believe you have violated these Terms or engaged in prohibited activities. We may also report suspected illegal activity to appropriate law enforcement authorities.

7.3 Consequences of Violations

Violations of these Terms may result in:

  • Immediate termination of your account without refund
  • Prohibition from creating new accounts
  • Legal action to recover damages and costs
  • Reporting to law enforcement authorities
  • Cooperation with legal proceedings against you

9.2 Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PIZZAPIZZA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

  • Our Services will meet your requirements or expectations
  • Our Services will be available at any particular time or location
  • Any defects or errors will be corrected
  • Our Services are free of viruses or other harmful components
  • The results of using our Services will be accurate or reliable

9.3 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PIZZAPIZZA, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use our Services
  • Any conduct or content of any third party on our Services
  • Any content obtained from our Services
  • Unauthorized access, use, or alteration of your transmissions or content
  • Food allergies, dietary restrictions, or health issues related to consuming our products

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX MONTHS PRECEDING THE CLAIM, OR $100 CAD, WHICHEVER IS GREATER.

9.4 Indemnification

You agree to indemnify, defend, and hold harmless PizzaPizza, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your conduct in connection with our Services

10. Dispute Resolution

10.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

10.2 Jurisdiction

You agree that any legal action or proceeding arising out of or relating to these Terms or our Services shall be brought exclusively in the courts located in Toronto, Ontario, Canada. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

10.3 Informal Resolution

Before filing any formal legal action, you agree to first contact us at orders@pizzaipizza.org to attempt to resolve any dispute informally. We will make good faith efforts to resolve disputes through informal negotiation.

10.4 Time Limitation

Any claim or cause of action arising out of or related to our Services must be filed within one (1) year after the claim or cause of action arose, or it will be permanently barred.

10.5 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.


11. General Provisions

11.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on our Services, constitute the entire agreement between you and PizzaPizza concerning our Services and supersede all prior agreements and understandings.

11.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

11.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of PizzaPizza.

11.4 Assignment

You may not assign or transfer these Terms or your rights and obligations under these Terms without our prior written consent. We may assign or transfer these Terms or our rights and obligations under these Terms at any time without restriction.

11.5 Force Majeure

We shall not be liable for any failure or delay in performance of our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

11.6 Survival

All provisions of these Terms which by their nature should survive termination shall survive termination, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11.7 Language

These Terms are written in English. Any translation is provided for convenience only. In the event of any conflict between the English version and any translation, the English version shall prevail.
